Policies Currently Out for Review

The following policies and operating rules have been approved for a 30-day comment period.

*Please note that policy no. H-4 will go into effect if and only if the Court determines it is enforceable in WV. Mountwest will continue using its current H-4 policy until these determinations are concluded.

2024 Title IX regulation is not enforceable in WV until further court action, however, institutions should still work on revising existing policies and procedures to comply with 2024 regulation in the event the Court determines it’s enforceable in WV.

From the Memorandum Opinion and Order

  1. The motions for a preliminary injunction/stay filed by Tennessee, Kentucky, Ohio, Indiana, Virginia, and West Virginia [Record No. 19] and Christian Educators Association International and A.C. [Record No. 63] are GRANTED.
  2. The United States Department of Education and Miguel Cardona, Secretary of the U.S. Department of Education, along with their secretaries, directors, administrators, and employees, are ENJOINED and RESTRAINED from implementing, enacting, enforcing, or taking any action in any manner to enforce the Final Rule, Nondiscrimination on the Basis of Sex in Education Programs or Activities Receiving Federal Financial Assistance, 89 Fed. Reg. 33474 (Apr. 29, 2024), which is scheduled to take effect on August 1, 2024.
  1. This injunction is limited to the plaintiff-States of Tennessee, Kentucky, Ohio, Indiana, Virginia, and West Virginia and extends to intervening plaintiffs Christian Educators Association International and A.C. in these six states.
